Rise DJs — Terms and Conditions

This Agreement (“Agreement”) is entered into between Rise DJs (hereinafter referred to as “the DJ,” “Provider,” or “Company”) and the undersigned Client (“Client”). Together, these parties agree to the terms outlined below.
1. Services
DJ/MC Services
- Client agrees to pay a non-refundable reservation fee of 50% to secure the DJ’s services.
- Final payment is due two (2) weeks prior to the event date.
- Payments are made through approved digital platforms (e.g., CheckCherry, Stripe). Checks are not accepted.
- Additional time beyond contracted hours may be accommodated when feasible and billed at the current overtime rate.
- The DJ provides professional music performance, event coordination, and MC services for the booked event.
2. DJ Service Details
- Arrival: DJ will arrive approximately 2 hours prior to the start time for setup.
- Breakdown: Allow approximately 45 minutes post-event for teardown.
- Venue Access: Client agrees to provide parking, elevator access, and safe working conditions at the venue.
- Meals: Client agrees to provide a meal and water for the DJ and any assisting crew during the event.
- Setup Requirements: Minimum 6x6 ft. area, table or DJ booth, and dedicated power source within 50 feet (unless using battery-powered equipment).
3. Photo Booth Services
Reservation & Payment
- A 50% non-refundable retainer is required to reserve the Photo Booth.
- Final payment is due on the same schedule as DJ services.
- No checks accepted.
Operation & Setup
- Requires a 10x10x10 ft. space and one power outlet within 50 feet.
- The booth operates for the contracted time as listed in your CheckCherry package.
- An attendant or DJ will assist guests throughout the event.
Deliverables
- Includes a standard backdrop, props, and digital photo gallery.
- Digital copies delivered via online gallery within 14 business days.
- Guests can access photos instantly via digital sharing.
- Custom backdrops, prints, or overlays available as add-ons.
Liability
- The Client is responsible for damages caused by guests.
- Rise DJs is not liable for guest injuries in or near the booth unless due to proven negligence.
4. Force Majeure
In the event of illness, accident, venue failure, severe weather, or other causes beyond the DJ’s control, Rise DJs will make all reasonable efforts to provide a qualified substitute.
If a substitute cannot be arranged, a good-faith refund plan will be established (standard $50/month installment default).
Retainers remain non-refundable, as they reserve your event date.
5. Liability
- DJ’s liability is limited to the total amount paid for the performance.
- The DJ shall not be held liable for indirect, incidental, or consequential damages.
- Client assumes responsibility for damages to equipment or property caused by guests, invitees, or venue staff.
- DJ maintains insurance and is responsible for their own equipment.
- For “rain or shine” events, the DJ’s fee is not reduced for weather conditions.
6. Outdoor Events
For outdoor venues:
- Client must provide overhead shelter, stable ground, and protection from rain or direct sun.
- A safe setup area (minimum 6x6 ft) and power within 50 feet are required.
- The DJ reserves the right to stop or relocate services in case of unsafe weather (wind, lightning, precipitation, etc.).
- The Client is liable for delays or damages caused by inadequate conditions or power.
7. Music Requests & Planning Timeline
- Client will complete a music planner and submit final song requests and event details no later than three (3) weeks prior to the event.
- Requests made inside that window will be honored at the DJ’s discretion.
- Rise DJs is not liable for dissatisfaction arising from last-minute changes or unprovided information.
- The DJ will make every effort to play all approved requests but cannot guarantee all songs’ availability.
8. Event Changes and Client Communication
- Any major event adjustments (timing, venue, format) must be communicated in writing at least three weeks in advance.
- Feedback and reviews should accurately reflect the DJ’s performance as agreed in the finalized plan.
- Client acknowledges that last-minute changes may affect flow or availability and are outside the DJ’s control.
9. Non-Payment
- Failure to pay outstanding balances will result in service cancellation and possible legal collection.
- Client agrees to pay court fees, legal costs, collection expenses, and a $250 administrative service fee per notice issued.
- Non-payment constitutes a breach of contract.
10. Media, Photography & Brand Protection
Grant of Rights
- Client grants Rise DJs permission to capture photo, video, and audio of the event for professional or promotional use.
- Guests are deemed to have consented to such recording by attending.
- All use of content will be respectful and non-defamatory.
Ownership & Restrictions
- Rise DJs retains full ownership of all content captured by its staff.
- Client, guests, or vendors may not publicly distribute or alter media featuring Rise DJs or its staff in any defamatory, misleading, or disparaging way.
- Rise DJs reserves the right to request removal or correction of any misrepresentative media.
- Violations may result in legal action and recovery of damages.
11. Indemnification
The Client agrees to indemnify and hold harmless Rise DJs, its employees, and contractors from all claims, damages, or losses arising from:
- Injury or property damage caused by Client or guests.
- Copyright infringement related to requested music or materials.
- Violations of venue rules or local laws.
- Breach of contract or willful misconduct.
This indemnity includes defense costs and reasonable attorney’s fees.
12. Age Requirement
Client affirms they are 18 years of age or older and legally authorized to enter into this agreement. If signing on behalf of another party, they accept full personal responsibility for compliance.
13. Dispute Resolution
- Both parties agree to good-faith negotiation before taking legal or arbitration action.
- Unresolved disputes will proceed to binding arbitration under the American Arbitration Association in Denver, Colorado.
- Judgment on the award may be entered in any court of competent jurisdiction.
- The prevailing party is entitled to recover reasonable attorney’s fees and costs.
14. Addendums, Severability & Entire Agreement
- All signed addendums form part of this Agreement and supersede prior communications.
- If any clause is found unenforceable, the remainder shall continue in full force.
- This document represents the entire agreement between Rise DJs and the Client.
- Modifications must be in writing and signed by both parties.
15. Governing Law & Binding Effect
This Agreement shall be governed by the laws of the State of Colorado and shall bind both parties upon digital signature or acceptance through CheckCherry.com.
16. Data Protection & Privacy
a. Purpose & Scope
Rise DJs respects your privacy and is committed to protecting your personal information in accordance with applicable laws, including the Colorado Privacy Act (CPA) and California Consumer Privacy Act (CCPA) where applicable.
This section explains how we handle personal data collected during the booking, planning, and performance of your event.
b. Information Collected
Rise DJs may collect, store, and process the following personal data:
- Contact details: Names, emails, phone numbers, and addresses.
- Event details: Venue information, dates, and timelines.
- Payment data: Processed securely through third-party providers (e.g., CheckCherry, Stripe) — Rise DJs does not store card or banking information directly.
- Media data: Photos, videos, and recordings from the event (as outlined in Section 10 – Media & Brand Protection).
- Guest interactions: Photo booth or message submissions, only for the purpose of delivering media galleries or event-related content.
c. Use of Information
Your data is used strictly for:
- 📅 Managing your booking and event communications.
- 💳 Processing payments through secure gateways.
- 🎧 Delivering DJ, MC, lighting, and photo booth services.
- 📸 Sharing event photos and digital galleries.
- 💌 Sending updates or offers (only with your consent).
We never sell, rent, or share personal data with unrelated third parties.
d. Storage & Security
- All data is stored securely on encrypted servers or trusted platforms (e.g., CheckCherry, Stripe, Google Workspace).
- Payment details are handled exclusively by PCI-compliant processors.
- Access to personal data is restricted to authorized Rise DJs staff on a “need-to-know” basis.
- Digital photo galleries are hosted through secure, private links with optional password protection.
e. Retention
We retain event and client data only as long as necessary for business, tax, or legal purposes.
Media files (e.g., photo booth galleries) may remain available for up to 12 months unless the Client requests early removal.
f. Client Rights
Clients have the right to:
- Request access to their data.
- Request correction or deletion of personal information.
- Opt out of promotional communication at any time.
Requests can be sent to info@risedjs.com with the subject line “Privacy Request.”
g. Data Sharing with Partners
In limited cases, Rise DJs may share relevant event data (e.g., timeline or setup details) with:
- Event planners or coordinators.
- Venue management (for technical setup coordination).
- Photographers/videographers (for sound and lighting sync).
All partners are expected to comply with strict confidentiality and data protection standards.
h. Data Breach Protocol
In the unlikely event of a data breach, Rise DJs will:
- Notify affected clients within 72 hours of discovery.
- Provide details of compromised data and protective steps.
- Cooperate with any lawful investigations or requests.
i. Client Responsibility
Clients are responsible for ensuring that guests providing personal data (e.g., through the photo booth or RSVP forms) are aware of and consent to Rise DJs’ handling of such data as outlined in this section.
